1. General
Felicity Rutherford Art (“we,” “us,” or “our”) provides art pieces for purchase through this website. By using this Site, you confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian.

We reserve the right to update, change, or replace any part of these Terms and Conditions at our sole discretion. Continued use of the website following any changes constitutes acceptance of those changes.

2. Products and Orders
We take great care to ensure all product descriptions and prices are accurate. However, we reserve the right to refuse or cancel any order due to product availability, pricing errors, or other issues.

By placing an order, you agree to provide current, complete, and accurate purchase and account information.

3. Pricing and Payment
All prices are listed in AUD and include applicable taxes unless otherwise stated. Payment must be made in full at the time of purchase via the payment methods provided at checkout.

4. Shipping and Delivery
Original paintings will be packed and shipped within 5 working days unless otherwise notified. You will receive a notification once your order has been collected for delivery.

For Mini and Midi-sized items, we generally use Australia Post where possible. As per Australia Post’s current guidelines, please allow approximately 5–8 working days for delivery within Australia. For Maxi-sized items, a courier service will be used, and you will be informed of the shipping details once they are available.

Shipping Costs
Shipping is included in the price for Mini items shipped within Australia. Midi and Maxi-sized works will incur an additional delivery fee, which will be added to the purchase price to cover shipping costs.

If you wish, you may arrange to collect your item directly from us. We will ensure the artwork is suitably packed and will notify you once it is ready for collection. In some cases, if you are located within a local radius, we may be able to deliver the item to you personally or arrange a convenient time for you to collect it yourself. Please contact us directly to discuss these options.

International Shipping
We can arrange international shipping upon request. Please contact us to enquire about shipping outside of Australia, and we will confirm if we can accommodate your destination. If shipping is available, we will provide quotes for packing and delivery. You are also welcome to arrange your own collection and shipment from us if preferred.

Any overseas shipments may be subject to import duties, taxes, and fees as determined by the destination country. These charges are the responsibility of the customer. We have no control over these costs and accept no responsibility for any additional charges incurred.

Please note that we are currently unable to offer refunds or returns for items shipped outside of Australia.

If the final shipping cost is significantly higher than initially quoted, we reserve the right to hold the product and issue a revised shipping invoice before dispatch.

5. Returns and Refunds
At Felicity Rutherford Art, we take great care to ensure that each artwork is represented and delivered to the highest possible standard.

Change of Mind
Every effort is made to accurately represent the artwork’s size, colour, and appearance. However, please note that variations in colour may occur due to differences in screen settings, devices, and browsers. Any such variation between the online image and the actual artwork is not considered a fault, and minor inconsistencies will not constitute grounds for return.

If your artwork does not meet your expectations, you may request a refund within 14 days of receiving your order. To do so, please contact us by email to discuss your return. Once a return has been agreed upon, you are responsible for securely repackaging the artwork and arranging return delivery using the same service that was used for the original shipment. Refunds will be issued within 14 days of the artwork being safely returned and inspected.

Damaged Items
All artworks are carefully wrapped and packed to ensure safe delivery. If you suspect damage has occurred during transit, please take a photograph of the parcel before unwrapping. If your artwork arrives damaged, please contact us within 7 days of delivery and include clear photographs showing the issue. We will assess the situation and, where appropriate, offer a replacement or refund.

International Orders
Please note that at this time we are unable to offer refunds or returns for any artworks shipped outside of Australia.
6. Intellectual Property
All content on this website, including text, images, logos, product names, and graphics, is the property of Felicity Rutherford Art and may not be used or reproduced without written permission.

7. Copyrights and Reproduction
Copyrights and reproduction rights remaining with the artist and written permission from the artist would be required to replicate this work in any capacity.

8. Privacy Policy
Your use of our website is also governed by our Privacy Policy. We are committed to protecting your personal information and using it responsibly.
